Dispute Resolution Process for Families

Under the McKinney-Vento Homeless Assistance Act, state and local educational agencies (SEAs and LEAs, respectively) are required to follow a formal dispute resolution process when parents, guardians, or unaccompanied youth disagree with a school’s determination regarding eligibility, school selection, or enrollment [42 U.S.C. § 11432(g)(3)(E)].

This process ensures that all parties have the opportunity to present their perspectives and that disagreements are addressed promptly and in accordance with McKinney-Vento provisions.

Ewing Public Schools’ dispute resolution procedures for families experiencing homelessness is outlined here. These procedures are designed to facilitate the timely and fair resolution of disputes related to the school enrollment or placement of homeless children and youth.

If a dispute arises, Ewing Public Schools will provide the parent, guardian, or unaccompanied youth with Form 10 – School District Dispute Resolution Form.

This form includes:

  • A written explanation of the district’s decision,

  • Contact information for the District Homeless Liaison and the Executive County Superintendent, and

  • A section for the parent, guardian, or unaccompanied youth to submit their written explanation should they choose to appeal the district’s decision to the Executive County Superintendent.
