Anti-Bullying Bill of Rights

 

The Ewing Township Public Schools are dedicated creating a positive, safe, and productive school climate and culture for all students. Since the adoption of the Anti-Bullying Bill of Rights Act in 2011, the district has made great strides in addressing issues related to harassment, intimidation and bullying (HIB) by providing training for the entire staff and advanced training for each school's anti-bullying specialists, implementing programs for all students and staff designed to address HIB, and providing age-appropriate classroom lessons focused on the definition and impact of bullying, building empathy among students, and teaching strategies for conflict resolution. 

 
Anti-Bullying Bill of Rights
On January 5, 2011, Governor Christie signed into law the "Anti-Bullying Bill of Rights."  The new law went into effect in September 2011, amended the 2002 anti-bullying law, and provided several major changes including a new definition for "Harassment, Intimidation and Bullying," district staff functions, policy and procedures, training requirement, and reporting procedures.

DEFINITION OF HARASSMENT, INTIMIDATION or BULLYING (HIB)
      Types of Behavior Includes:
            ANY gesture, or
            ANY written, verbal or physical act, or
            ANY electronic communication
            Can be a single incident or series of incidents
      Motivation for HIB Behavior:
            ANY actual OR PERCEIVED characteristic
            EXAMPLES:  race, color, religion, ancestry, national origin, gender, sexual orientation,
            gender identity or expression, mental/physical/sensory disability,
            or ANY OTHER DISTINGUISHING CHARACTERISTIC
 
LOCATION OF INCIDENT
On school property
At school-sponsored function
On a school bus
Off school grounds (including cyberspace)
 
SUBSTANTIAL DISRUPTION
Substantially disrupts or interferes with the orderly operation of the school or the rightsof other students
 
HIB MUST MEET ONE OF THE FOLLOWING CONDITIONS in addition to causing substantial disruption or interference:
  1. A reasonable person should know that the act will have the effect of physically or emotionally harming a student or damaging the student's property, or
  2. Has effect of insulting or demeaning any student or group of students, or
  3. Creates hostile educational environment for student by interfering with student's education, or
  4. Severely or pervasively causing physical or emotional harm to student.

DISTRICT CODE OF CONDUCT
The district maintains policies and regulations to govern student behavioral expectations and developmentally appropriate consequences, which includes preventive and/or corrective action plans.  The Student Discipline/Code of Conduct (P5600) and Elementary Behavior Guide (R5600.1) are available on the district website.

DIRECTIONS TO REPORT CONCERNS ABOUT POSSIBLE BULLYING

Any caregiver can communicate concerns about possible bullying by contacting the school's anti-bullying specialist directly. A caregiver can also complete a form called the HIB 338 Form, which is to be submitted to the school principal or anti-bullying specialist. Once the HIB 338 Form is submitted to the school's principal or anti-bullying specialist, the school must follow the processes put in place by the New Jersey Department of Education.
